.ASIA: addendum and clarifications on SR2C and SR3


On the 25 of October 2007, DotASIA released a Sunrise policies Addendum and clarifications and provides additional considerations for sunrise 2C (SR2C) and sunrise 3 (SR3).

 

The following additional considerations will be allowed during SR2c and SR3 :


Registered Marks without Nice Classification on SR2C

The .ASIA Registry is aware of the fact that not all countries in the world have ratified the Nice Agreement and/or are using the Nice Classification. This addendum broadens the scope of SR2c eligibility to allow the inclusion of words and phrases contained in or relating to the description of goods and services of a Registered Mark.

If the words and phrases are taken from the registered description of goods and services, these should be in the language of the registration certificate or online record at the trademark office.Only descriptions in Latin based scripts will be considered.

Consistent with the SR2c provisions, plural or other grammatical forms of significant words and phrases (hyphenated or combined -- i.e. space removed) in the description of goods and services are also accepted.

Combination of Two or more Registered Marks on SR2C

This addendum extends that provision during SR2c for a Domain Name Applied For to be based on a combination of two (2) or more Registered Marks (hyphenated or combined). Further combination of words or phrases (hyphenated or combined -- i.e. space removed) from the Class of either one of the Registered Marks and/or the description of goods and services will also be accepted.

Addendum on SR3

This addendum does not change the nature of SR3, for which Applications are “unverified”. However, four significant enhancements are included to facilitate priority for companies and brand owners:

Considerations for officially used initials, short forms and omission of locality indicators

The Verification Agent may request further documentation demonstrating the official use of the form specified in the Domain Name Applied For. Official use includes usage in communications with customers, suppliers, or third parties, such as business cards, advertisements, signage or other published materials.

Acceptance of standard Romanization and transliterations of non-Latin based languages (or scripts) for both Entity Names (e.g. company names) and Registered Marks

Romanized or transliterated registered mark will be accepted on SR3.

Because a Romanized or transliterated form of a Registered Mark (and company name) cannot be verified definitively by the Verification Agent, applications for Domain Names based on such Registered Marks are accepted in SR3 rather than SR2. Nevertheless, the Romanization should follow a standard published by a competent authority within the DotAsia Community.

A declaration of the Official English Name may be requested by the Verification Agent. Such declaration should clearly indicate that the Official English Name represents the entity described in the submitted documentary evidence for the SR3 application.

Registered Marks Containing an Existing TLD as a Suffix or locality indicators

This addendum extends the exception provisions to allow holders of Registered Marks and Entity Names that contain a suffix that is identical to and intended to express an existing gTLD (a list can be found at http://www.iana.org/gtld/gtld.htm) or a ccTLD (http://www.iana.org/root-whois/index.html) to omit such extension from the Domain Name Applied For during Sunrise 3 (SR3).
